Job Description and Duties

Under the direction of the Chief Counsel of the Office of the Director Legal Unit (OD Legal) and the Assistant Chief Counsels, Attorney III's represent the Director of the Department of Industrial Relations (DIR), the Department, and division chiefs and managers in a variety of subject areas within the responsibility and jurisdiction of the Department. Responsibilities include, among others, representing the Director in workers’ compensation cases involving special funds administered by the Director (SIBTF, UEBTF and DWD), representing the Department in internal DIR personnel matters, and providing legal advice and representation in public works, prevailing wages, Public Records Act, litigation, and other matters concerning a wide variety of legal issues that may arise in the operation of the Department. Attorney III's have mid-level experience, and are expected to independently handle a busy caseload, to have solid lawyering skills, including strong research and writing skills, and to have some level of subject matter expertise in or more areas of the Department's responsibility.

Attorneys in this position work with a high level of independence, while also receiving support and supervision from OD Legal Assistant Chief Counsels and the Chief Counsel. They are required to communicate effectively both orally and in writing as required for the specific job duties, including by drafting legal briefs, memorandums, and correspondence on a regular basis; to appear in workers' compensation administrative proceedings as assigned; to appear in other civil and administrative court proceedings, as assigned; to communicate in a professional, respectful and productive manner with opposing counsel, clients, stakeholders, colleagues, and the public; to travel as necessary and as assigned; and to demonstrate good judgment and act with high ethical standards.

The ability to travel for a short duration (one to two days) is required for this position.

Following the probationary period, regular telework may be considered, in consultation with the supervisor, although work days in the office will also be required.

Effective July 1, 2020, State employees are subject to a 9.23% salary reduction in exchange for up to 16 hours of the Personal Leave Program 2020 (PLP 2020) per month. Working Conditions

This is a full-time position located in the Department of Industrial Relations, Office of the Director Legal Unit ("OD Legal"). Employees in this position work in an office environment, have their own offices, work at desks, and are required to work extensively on computers as necessary for the drafting of letters, briefs and other documents, and for research, email communication, file review, training and other purposes. Attorneys are expected to handle their own word processing, and secretarial support is generally limited to the finalization and filing process. This position requires occasional in-state travel, either locally, or for one to two-night stays at other locations within California, based on assignments, and as determined according to the needs of the Department. This is a full-time, Monday through Friday, position. Attorneys are expected to work all hours as necessary to accomplish their assignments, and although they will generally average a 40-hour week, longer work hours may occasionally be required. There is some flexibility as to the specific work schedule, which will be determined after hire in consultation with the Chief Counsel or Assistant Chief Counsel.

Special Requirements

In order to apply for this position, you must submit a Statement of Qualifications answering the questions below in addition to the standard application form. A resume cannot be submitted in lieu of the SOQ, and generally resumes are not reviewed. In addition, you must submit TWO writing samples, drafted within the past 24 months. These writing samples should reflect your own writing, including in the form of filed briefs, if available. The writing samples should be limited to 15 pages each and should be submitted in pdf format. If the original brief is longer than 15 pages, it is acceptable to just crop the brief and submit the first 15 pages.

The SOQ should be typed in 12-point font, with 1.5 or double-spacing, and be no more than three (3) pages in length.

Questions to be answered in the SOQ (please copy and paste these questions into your document):

1. Briefly summarize your prior experience in civil or administrative litigation, including with respect to the subject areas in which you have practiced, the courts or other forums in which you have practiced, the responsibilities you have handled, and the extent of your law and motion, trial, and/or appellate experience.

2. Briefly describe two significant matters you handled that you feel demonstrate your skills and accomplishments as an attorney. Include a brief summary of the matter, and explain what it is about the results, outcome or circumstances that you feel reflects well on your abilities as an attorney.

3. Have you ever written any briefs for filing in the California Court of Appeal, California Supreme Court, or any federal appellate court? If so, please provide an estimate of the number of state and federal appellate briefs you have authored. If you have been counsel in any cases resulting in published opinions, provide the case cites.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

Strong legal research, analysis and writing skills.
Strong oral and written communication and advocacy skills.
Prior experience writing and filing briefs in the Superior Court, California Court of Appeal and/or California Supreme Court.
Knowledge of state and/or federal civil procedure and prior experience in civil litigation or administrative law experience.
Ability to organize and manage a high volume of work, and perform in potentially stressful situations.
Strong interpersonal skills and the ability and desire to contribute to a collegial office environment.
Proficiency in Word and other Microsoft applications.

The Oakland office of OD Legal is located in a pleasant office environment, with proximity to shopping areas and restaurants. It is a close walking distance from the 12th Street BART station, and a BART voucher is part of the benefits package. Following the probationary period, some amount of regular telework is a possibility, although days in the office will also be required.
