Job Description and Duties

At the California Department of Justice – Office of the Attorney General, you will be part of a diverse group of over 5,000 dedicated professionals whose chief mission is to deliver fairness and equality under the law through a broad spectrum of programs and services.

Deputies assigned to the Employment and Administrative Mandate Section (EAM) handle a broad range of civil litigation cases with a focus on all aspects of a public employment litigation practice. We defend over 100 state agencies in connection with lawsuits alleging discrimination, harassment, reasonable accommodation, and whistleblower retaliation claims, among others. EAM also prosecutes disciplinary matters before the State Personnel Board. EAM deputies also conduct personnel and EEO investigations on behalf of state agencies. The section has approximately 100 attorneys and paralegals practicing in offices throughout California. EAM’s employment litigation practice regularly involves high level legal analysis and briefing, jury trials, evidentiary hearings, and appellate arguments in state and federal courts.

Additionally, EAM represents such clients as the California Highway Patrol, the Department of Motor Vehicles, the California Horse Racing Board, the State Lottery Commission, and the Department of Alcoholic Beverage Control in a wide variety of legal matters including petitions for writ of mandate involving licensing issues, along with other regulatory matters, and including personnel privacy issues.

EAM deputies are expected to efficiently produce written work of excellent quality, including briefs in support of a demurrer or motions to dismiss, discovery motions, motions for summary judgment, mediation and trial briefs, and appellate briefs. EAM deputies need to be able to communicate effectively in a timely manner with supervisors, client representatives, and witnesses. Working cooperatively and effectively with many different people with different personality types including colleagues, supervisors, client representatives, and witnesses is also necessary. Desirable Qualifications

Candidates with superior verbal and writing skills are preferred. California civil litigation experience is also preferred. EAM deputies should have the ability to effectively take and defend depositions, interview witnesses, and examine both percipient and expert witnesses at hearings and trial. EAM deputies also should be able to effectively and efficiently conduct legal research as well as understand and use numerous documents from numerous sources. Additionally, EAM deputies should be able to effectively advocate for clients in writing, including preparing briefs before administrative bodies, trial courts, and appellate courts. The successful candidate must be able to interact effectively with a diverse group of attorneys, paralegals, support staff, and clients, as well as regularly take direction. EAM deputies are expected to behave with the highest level of professionalism including high stress situations, and understand and abide by the laws of the State of California, Rules of Professional Responsibility and ethics required of all attorneys of this office. EAM deputies are expected to handle a busy civil litigation caseload and have the ability to effectively manage several important matters simultaneously. EAM deputies are expected to manage their own work-related calendars with multiple deadlines and appearances in varied venues in a timely manner meeting all applicable deadlines. Candidates should be able to work a full-time schedule including long hours and weekends when necessary to effectively represent our clients. EAM deputies will be required to travel to conduct witness interviews and may be required to travel and attend lengthy trials in other counties requiring overnight stays. Employment litigation experience and experience conducting investigations is a plus, but not required.
