Job Description and Duties

The Labor Relations Counsel III will primarily provide legal support to the new Childcare Providers Labor Relations unit, including but not limited to providing advice and consult on the Building a Better Early Care and Education System Act, and other collective bargaining issues; and provide representation before the Public Employment Relations Board, superior court, and appellate court on matters related to Building a Better Early Care and Education System Act.  

In addition to the support for the Childcare Providers Labor Relations unit, incumbent will also perform the full complement of duties expected of a Labor Relations Counsel III employed with the Legal Division, including but are not limited to representation in merit issue complaints, personnel actions, and whistleblower cases before State Personnel Board; discrimination claims before the Department of Fair Employment and Housing.

CalHR has temporarily adopted telework for employees who can perform their essential work functions remotely.

  • Experience representing clients before the Public Employment Relations Board in unfair practice charge proceedings, including appeals to the Board and writ petitions to the appellate court
  • Experience conducting hearings before administrative bodies in matters of greater difficulty and complexity, in such forums as the Public Employment Relations Board, the State Personnel Board, CalHR's Statutory Appeals Unit, Office of Administrative Law, or Department of Labor
  • Experience conducting litigation in state and appellate courts
  • Ability to communicate effectively, both verbally and in written form
  • Ability to analyze legal principles and precedents and apply them to complex legal and administrative problems
  • Ability to draft opinions, pleadings, rules, regulations, and legislation in a clear and logical manner
